Welcome to FYB-Fuel Your Body – Healthy Meal Delivery Inc. (“Fuel Your Body,” “FYB,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at https://www.eatfyb.ca (the “Site”), our meal delivery services, and any tools, features, products, or content provided through the Site (collectively, the “Services”).

By accessing or using our Site, placing an order, or subscribing to our meal plans, you confirm that you have read, understood, and agree to be legally bound by these Terms, along with our Privacy Policy and Return Policy. If you do not agree with any part of these Terms, you must not use our Services.

1. Eligibility and Account

By using our Services, you represent that you are the age of majority in your province of residence (Prince Edward Island or New Brunswick) or have obtained consent from a parent or legal guardian. You agree to provide accurate, complete, and current information and to keep your login credentials secure. You are solely responsible for all activity under your account.

2. Product Availability and Limitations

Our prepared meals are only available for delivery and pickup within approved service areas in Prince Edward Island and New Brunswick.

We do not offer any customization or substitution of ingredients. Meals are provided as listed. Vegetable varieties may differ from product images depending on seasonal availability and supplier logistics.

Product images are for illustration only and may not accurately represent delivered meals. We reserve the right to limit quantities or discontinue items at any time.

3. Orders and Subscription Billing

All meal plans renew weekly and are billed every Thursday at 12:00 PM Atlantic Time (the “anchor billing time”). If your plan was set up prior to Thursday, your billing will recur weekly at that time. If you set up your plan during the week of delivery, your next billing will occur on the following Thursday.

Our system automatically pre-selects your meals based on availability. It is your responsibility to log into your account and modify selections before the cutoff. We send a reminder email with a direct account link one day before billing to allow you to make changes, skip, or pause.

Once the billing deadline passes, your order is locked, and no changes or cancellations are accepted. Orders are non-refundable.

4. Pricing and Taxes

All pricing is in Canadian dollars (CAD). We do not charge HST or sales tax on prepared meals, in accordance with federal tax guidelines. However, applicable taxes may be built into delivery fees or other service charges as required by law.

Prices are subject to change without notice. You agree to provide accurate and updated billing details and authorize us to charge your payment method accordingly.

5. Delivery, Pickup, and Storage

Meals are delivered in insulated cooler bags with ice packs. You will receive delivery confirmation via email upon drop-off. Ownership and responsibility for the meals transfer to you at that time.

Meals received Sunday or Monday are marked with an expiration date of end-of-day Saturday of the same week. Meals must be stored at or below 4°C (39.2°F) immediately upon receipt.

Heating instructions are provided on each meal container lid and in our FAQ section. All meals must be reheated to a safe internal temperature of 74°C (165°F) or higher before consumption.

We are not liable for any food spoilage, illness, or injury resulting from improper handling, delay in refrigeration, or failure to follow food safety instructions.

Meals not picked up by end of day Friday from designated pickup locations will be donated and are non-refundable.

6. Cancellations and Returns

Due to the perishable nature of our meals, all sales are final after Thursday at 11:30 AM (Atlantic Time) for the upcoming week. No refunds, returns, or exchanges will be issued for missed pickups, dislikes, or changes after the cutoff.

7. Allergens and Food Safety

Our meals are produced in a commercial kitchen that handles gluten, dairy, eggs, soy, sesame, shellfish, tree nuts, and peanuts. While we take precautions, we cannot guarantee the absence of allergen traces.

We do not offer allergen-free meals. If you have a food allergy or sensitivity, you must review all product descriptions on our website and each container lid before consumption.

By ordering from FYB-Fuel Your Body – Healthy Meal Delivery Inc., you acknowledge that it is your sole responsibility to verify ingredient safety, and we are not liable for any allergic reactions or related harm.

Nutritional information is listed on product descriptions and on the meal container lids. Values are based on average calculations and may vary depending on seasonal ingredients.

8. Intellectual Property

All content, branding, graphics, photos, product names, and service marks are the exclusive property of FYB-Fuel Your Body – Healthy Meal Delivery Inc. or its licensors. No content may be reproduced, copied, resold, or reused without our prior written consent.

9. Relationship with Shopify

Our store is powered by Shopify Inc., which provides the e-commerce platform for our Services. All transactions are processed through Shopify, but Shopify is not a party to your order and is not liable for issues with products, billing, or fulfillment.

10. Third-Party Tools and Links

We may provide access to optional tools or third-party websites. These tools are provided "as is" without warranties or guarantees. Use of external services, including payment processors, Meta (Facebook/Instagram) advertising, Google Ads, or analytics tools, is at your own risk.

11. Feedback and User Submissions

If you submit feedback, suggestions, or reviews, you grant us the right to use and publish this content without restriction. We may edit or remove content at our discretion and are not obligated to maintain confidentiality.

12. Prohibited Conduct

You may not use our Services:

  • For unlawful purposes

  • To transmit malicious code

  • To violate intellectual property rights

  • To interfere with or disrupt our website or operations

  • To impersonate any person or entity

We reserve the right to suspend or terminate your access for violations.

13. Disclaimer of Warranties

Our Services and products are provided “as is” and “as available,” without warranties of any kind. We do not guarantee the uninterrupted operation of our Site, nor do we warrant that products will meet your expectations. Your use is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, FYB-Fuel Your Body – Healthy Meal Delivery Inc., its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or our products.

15. Indemnification

You agree to indemnify and hold harmless FYB-Fuel Your Body – Healthy Meal Delivery Inc., Shopify Inc., and their respective employees, directors, and partners from any claims, damages, or losses related to your breach of these Terms, use of the Services, or violation of applicable laws.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Prince Edward Island, New Brunswick, and the federal laws of Canada. Any disputes shall be resolved in the appropriate courts located within these jurisdictions.

17. Changes to Terms

We may update these Terms at any time. You are responsible for reviewing the most current version, which will be posted on our website. Continued use of the Services constitutes your acceptance of the updated Terms.
